Delhi’s Chief Minister Aravind Kejriwal faced a setback in the Supreme Court. After Manish Sisodia and Kalvakuntla Kavitha were granted bail in the Delhi Liquor Scam case, Aravind Kejriwal was the only prominent politician to be granted bail. Seeking bail, he filed a plea in the Supreme Court.
The Supreme Court accepted Arvind Kejriwal’s bail plea, and the hearings went ahead today. A bench of Justices Surya Kant and Ujjal Bhuyan was hearing the matter. The Supreme Court has now reserved its orders on the bail plea.

“If the top court grants bail to Arvind Kejriwal, it will demoralize Delhi High Court,” said ASG S V Raju. However, Kejriwal’s counsel, Abhishek Manu Sindhvi, commented that Kejriwal cannot be a flight risk.
“Triple test is based on the presumption of innocence. The ultimate object is to secure presence. It would be best if you were not a flight risk. A man who is a constitutional functionary cannot be a flight risk,” he told the court.

The triple test requires a court to be convinced that the release of the accused will not involve a flight risk, tampering with evidence, or non-cooperation with further investigation. Singhvi also added that the CBI arrested Kejriwal on June 26, and no arrest had happened in two years.
Already, the Supreme Court has permitted the CBI to file its counter affidavit and has given Kejriwal two days to file a rejoinder.

Going back in time, Arvind Kejriwal was arrested on March 21 by the Enforcement Directorate (ED) for his alleged connection to the Delhi excise policy case. He was granted bail in May for a short period during the Loksabha elections.
