'Not Before Me' In Tirumala Laddu Case - Technically Not Right

The Laddu Adulteration Issue has reached the Supreme Court. YSR Congress is already celebrating as if it has won the case.

The next hearing of the case is posted on Thursday.

Meanwhile, some people are saying that one of the judges hearing the case was the lawyer for Jagan Mohan Reddy in his Bail Petition several years ago and so, should not be hearing this case.

But then, legal experts say that is not technically right.

Jagan is not the party in this case. Subrahmaniam Swamy, YV Subba Reddy, and others filed the Petition in the Supreme Court. Only if Jagan is one of the petitioners in this case, the ‘Not Before Me’ situation will arise.

The Honorable Judges in the Supreme Court are very vigilant about such issues. Things can not go wrong there.

The judge would have automatically recused himself from the case if Jagan had been a party.

Previously, the then Chief Justice of India UU Lalit refused to deal with the Amaravati case saying “Not before me”. Having been the personal advocate of Chief Minister Y.S. Jagan Mohan Reddy in the past, the CJI said that the petitions should be transferred to another bench.

Also, Justice Sanjiv Khanna recused himself from hearing Chandrababu’s Bail Petition.




Meanwhile, the SIT has completed the first phase of inquiry on this matter.
