A techie from Hyderabad served a legal notice to his former company, Tech Mahindra, for failing to give him a relieving letter.

Getting into details, V Balakrishna is an IT employee who joined Tech Mahindra in Hyderabad on November 9, 2023.

Within a few months after his joining, on February 23, 2024, he was asked not to come to the office, saying that his services were not needed anymore. Even his cab services and credentials were cancelled.

He left the company as per the order. However, it was recorded in the systems that February 28th was his last working day.

By not issuing the relieving letter, Balakrishna was harassed for six months by Tech Mahindra. Issuing a relieving letter is a Statuary right under the Central Industrial Employment (Standing Orders) Act 1946. If any employee resigns or gets terminated, he/she should get a relieving letter from the company.

Balakrishna filed a complaint at the Joint Commissioner of Labour, Ranga Reddy district, on April 8. After filing the complaint and attending multiple meetings with the company, Balakrishna was paid a partial salary. The company didn’t give him the relieving letter though.

Eventually, Balakrishna served a notice to Tech Mahindra.

It was stated that under the Telangana Shops and Establishments Act’s Section 47, giving a 60-day notice period upon resignation is illegal.

In the notice, Tech Mahindra was asked to give Balakrishna his relieving letter, giving him his full salary, pay his legal costs of Rs. 25000 which he incurred due to legal proceedings and including mental agony, making sure the employees are not made to sign a contract on service period or surety bond while joining the company and correct paid leave policy and resignation notice period as per the law of the Telangana state.




The notice has given time for Tech Mahindra till August 2nd to respond to the mentioned claims.
