Lost H-1B Visa Extension

One mistake can ruin years of effort. And for H-1B visa holders, that mistake doesn’t just haunt them emotionally but it can destroy their immigration status.

A man on H-1B recently shared his story when he was arrested last year for DUI (driving under the influence). After a plea deal, the charge was reduced to an infraction but the damage had already been done.

As he applied for his H-1B extension, he was hit with a dreaded RFE (Request for Evidence). He doesn’t even know what USCIS (US Citizenship and Immigration Services) wants yet but the fear is just setting in.

The US takes DUI charges very seriously and no matter how much the person regrets it now, he will have a dark spot against his name for life.

Other H-1B holders also chimed in saying their visas were revoked immediately after a DUI. Meanwhile, some claimed they had colleagues who somehow got lucky. People claim the case also depends on the officer who looks at your file.




It’s a reminder to every H-1B holder, that these are serious crimes and easily avoidable by taking a cab or calling a friend. That is why it is extremely deplorable how many people still fall for it every year.
