Famous Shah Bano Case Film: Makers’ Big Mistake?

Yami Gautam’s Haq has sparked controversy for using Shah Bano’s life story without permission. The daughter of the late Shah Bano Begum has issued a legal notice against the film, starring Emraan Hashmi and Yami Gautam Dhar, demanding a halt to its release and promotions.

Siddiqua Begum, represented by advocate Tousif Z Warsi, sent notices to director Suparn Verma, Junglee Pictures, Baweja Studios, and the CBFC. She wants the release, promotion, and streaming of Haq stopped until her family’s consent is granted.

The notice accuses the makers of using Shah Bano’s personal life and family events without permission. It calls the film an unauthorised and commercial exploitation of her late mother’s story.

It cites the Justice K.S. Puttaswamy (Retd.) v. Union of India (2017) judgment on privacy rights and the ICC Development (International) Ltd. v. Arvee Enterprises (2003) case on the unauthorised use of a person’s likeness.

The notice also warns that any depiction that distorts or damages Shah Bano’s image could lead to defamation. It reminds that the Copyright Act gives heirs moral rights to protect the reputation of their predecessors.

Siddiqua’s notice urges the CBFC to withhold or revoke Haq’s certification if the issue remains unresolved.

During the teaser launch, the makers said Haq was “inspired by the landmark Shah Bano judgment.” They have not yet released an official statement on the legal notice.

The dispute now clouds the film’s release and its take on one of India’s most talked-about legal battles.
