
The Hyderabad High Court has confirmed that anyone visiting a Brothel House can not be punished under the law unless he is a Brothel Owner or Pimp. The court categorically said this in relation to case filed on a Brothel Customer under the Immoral Traffic (Prevention) Act, 1956. The complainant belonging to Kukatpally was arrested by Police for visiting a Brothel but now the court has exempted him from the case.
According to Indian Penal Code, Section 3 of the Act imposes punishment for maintaining a brothel house, Section 4 imposes penalty for living on the earnings of prostitution, Section 5 deals with procurement, inducement or inducing a person for the sake of prostitution and Section 6 speaks about detaining a person on the premises where prostitution is carried out. Since a visitor of a brothel do not come under any of these sections, the court clarified that he can not be booked under this section and claim.
