CBN’s Arrest Is Illegal, Unlawful: Ex CBI Dir.

TDP supremo Chandrababu Naidu was arrested by AP CID under objectionable and seemingly unlawful conditions earlier today. In this context, CBI ex-director Nageswara Rao was asked about the nature of CBN’s arrest and here’s what he had to say.

“In order to arrest Chandrababu Naidu, a prior permission from the governor is mandatory. Failure to do so would mean that the arrest is an illegal and unlawful one. This is against the general practice” the ex director of CBI stated.

“Anti corruption code 17A(C) clearly states that the governor’s written permission is needed to carry out the arrest of an opposition leader. We don’t know if the AP CID officers had the necessary permission” he added.

It is added that that arresting officers should show the governor’s permission before arresting the individual, else it can be nullified. There could even be legal action against the enforcement officials if legal avenues are pursued.”

Going by the comment from the ex director of India’s biggest law enforcement agency, it could be understood that the arrest of CBN is unlawful. Will those involved with this controversial development face the legal wrath later? We shall see.
