
The Telangana High Court has clarified that political comments on social media do not automatically qualify as criminal offences. A primary investigation is necessary before taking any legal action, the Court observed.
The Court stated that not all posts on social platforms should be treated as crimes. Only cases involving defamation, incitement to violence, or threats to peace and security may proceed to court.
The High Court made these remarks while hearing a petition filed by Nallabalu or Durgam Sasidhar Goud. He sought dismissal of three cases filed against him for posts criticising the Congress in Ramagundam and Karimnagar.
After reviewing the matter, the Court struck down all the cases against him. The Justice ruled that political speech, no matter how exaggerated, should not be brought to the High Court.
Further, the Court issued clear guidelines to police and Magistrate Courts. It emphasised that political opinions are not punishable under criminal law and should not result in court proceedings.
This ruling aims to prevent biased or one-sided investigations into political commentary and upholds the right to free political expression.
