USA: Indo-American Doc in Trouble Due To False Claims

An Indo-American gynecologic oncologist Vinay K Malviya has agreed to pay a fine of $775,000 to resolve allegations of the violation of the False Claims Act. According to the justice department, Vinay Malviya agreed that he submitted false payment claims to federal health care programs related to unnecessary medical procedures that he performed.

In a settlement announced by the Department of Justice on Thursday, it was explained that the Michigan-based physician Malviya “submitted false payment claims to federal healthcare programs, knowingly.” The DOJ said that the claims submitted related to modified radical hysterectomies and radical hysterectomies, chemotherapy services, and evaluation and management services, from February 1, 2011, to June 30, 2017, that were not performed or not rendered as claimed.

In August 2021, Ascension Michigan and related hospitals agreed to pay $2.8 million to settle claims of violating the False Claims Act by submitting or causing the submission of false claims for payment to federal health care programs performed by Vinay Malviya.

The DoJ further said that Malviya agreed to be excluded for a period of three years from Medicaid, Medicare, and all other federal health care programs as part of the settlement. During that time, federal health care programs will not pay anyone for products or services, including management or administrative services, ordered, furnished, or prescribed by Malviya in any capacity.
