Surname War Reaches Court: Mother Fights School Rule

The Kerala HC has delivered an important ruling in a case involving the surname rights of children. The judgment clarified that a child can use the surname of the biological father under certain circumstances.

The case titled XXX Vs. State of Kerala and Ors was filed by a mother of two children. The children were born from an extramarital relationship.

According to the petition, a school refused admission to the children unless they used the surname of the mother’s current husband. This condition led the mother to approach the court seeking relief.

The legal request was mainly made for the daughter, who is still a minor. The son involved in the case has already reached adulthood.

In the case proceedings, the fourth respondent was identified as the biological father of the children. He is also the former husband of the woman who filed the petition.

After reviewing the matter, the court directed that a fresh affidavit be issued with the corrected names of the children. The order allows the children to use the surname of their biological father.

The ruling is considered significant because traditionally children often carry the surname of the mother’s husband. The court noted that identity and naming can also be a matter of personal choice.

The judges expressed concern for the minor girl and emphasised that she should not grow up with a surname that does not reflect her identity.

The court also observed that a child should not face stigma because of the circumstances of birth. The responsibility for such situations does not lie with the child.

Although the biological father was reportedly not involved in raising the children, the court maintained that the child’s identity and dignity must be protected.

The judgment highlights the importance of recognising a child’s right to identity and ensuring that institutional rules do not override personal rights.
