Abortion Pills Courier Case: High Court’s Shocking Verdict

The Rajasthan High Court has cancelled a police case against a woman accused of sending abortion pills through a courier. Justice Anoop Kumar Dhand ruled that mailing such medicine does not amount to a criminal offence.

The case has drawn attention as it highlights the need for proper evidence in legal matters. The court stressed that charges cannot be based on personal disputes or assumptions. Legal action must rely on clear proof and intent.

The background of the case reveals a family dispute. The woman, Ishita, had earlier filed a domestic violence case against her husband. Later, a complaint was filed against her with allegations of sending abortion pills from Jaipur to Kota.

According to the complaint, the pills were sent to end a pregnancy. However, the court found inconsistencies in the case. Ishita’s name was not mentioned in the original police report and was added later.

The judge observed that this step appeared to be an attempt to harass her. Under Section 312 of the IPC, sending medicine by courier is not considered an offence. A crime requires forceful action with intent to cause miscarriage.

In this case, there was no evidence of force or illegal intent. The court noted that the legal process was being misused to settle personal issues. This raised serious concerns about the misuse of law.

By quashing the FIR, the High Court reinforced the importance of fair legal procedures. The ruling ensures that individuals are protected from false accusations. It also sets a clear example for handling similar cases in the future.
