Day 1 CPT: Loophole or Trap for F-1 Students?

Another student on OPT (Optional Practical Training) is stuck between a job offer and a ticking visa clock.

With his work permit running out by September, the F-1 visa holder chose the increasingly popular, yet risky, Day 1 CPT (Curricular Practical Training) route by enrolling in a Doctorate of Business Administration. It’s a loophole many international students are now using to keep working in the US. But there’s a catch.

To legally work under CPT, your employer must sign paperwork confirming your job is directly tied to your course. But in the current political climate, it is becoming increasingly hard.

Employers are either confused, hesitant, or flat-out refusing to sign the form, as, for the authorities, it is easier to flag Day 1 CPT due to more restrictions on the job than the OPT permit.

As this student’s job starts in two weeks, he is feeling nervous. The employer has been informed about the CPT program, but hasn’t signed yet, leaving the F-1 holder wondering if they should start working and hope for the best, or ask before day one and risk losing the offer.

It’s a tough call, but there is no doubt that the USCIS is cracking down on Day 1 CPT misuse. If the job and coursework don’t align perfectly, it could lead to RFEs (Requests for Evidence) or worse, visa denials.

What was once seen as a shortcut is now becoming a trap for international students.
