Day 1 CPT Getting Risky: H-1B Workaround or Trap?

The backup option many F-1 students once trusted is now beginning to feel uncertain. A rising number of students and workers are questioning if Day 1 Curricular Practical Training, known as CPT, is still reliable amid stricter immigration checks.

For several years, Day 1 CPT worked as a legal yet debated fallback after failed H-1B attempts. Many workers who missed the lottery joined another Master’s or PhD programme to secure work authorisation from the beginning.

This allowed students to retain their F-1 visa status while reapplying for H-1B the next year. Attendance requirements were often minimal. In many cases, attending classes once or twice a semester was considered enough.

However, that sense of ease is now fading. The US job market has tightened, and layoffs in H-1B and OPT roles have increased. The system no longer appears to be actively seeking international talent like before.

With growing scrutiny, issues are not always immediate during CPT approval. Instead, concerns are emerging later. Cases that seem fine initially may get flagged during H-1B filings or even during green card processing.

A CPT work permit is meant to be part of a genuine academic programme. Students are expected to actively study and participate, not simply remain enrolled on paper.

The gap between official rules and actual practice has existed for years. Now, this gap may create complications much later, especially during a change of visa status.

More applicants shifting status, particularly from H-1B to F-1 or B-1 or B-2 to F-1, are reportedly facing scrutiny. Many are receiving requests for evidence and even notices of intent to deny.

In the current situation, several F-1 students are choosing to leave rather than enter uncertain legal territory. Others still opt for Day 1 CPT out of necessity, but the long-term risks are becoming increasingly difficult to ignore.
