
The Department of Homeland Security (DHS) has proposed a new rule that ends “duration of status” for F-1 students. This means F-1 visas will no longer be valid for the entire program duration but will have a fixed expiry date.
Restrictions on Pursuing Multiple Degrees
The new rule also stops students from getting F-1 status for a program at the same or lower educational level after completing one. So, students cannot pursue double bachelor’s or double master’s degrees in the US. The only option after a master’s is to enrol in a PhD program.
Impact on Day-1 CPT and Work Opportunities
Many colleges currently allow Day-1 Curricular Practical Training (CPT), where students can work off-campus from day one. This practice will continue but will be strictly tied to the new fixed visa period.
Post-Completion OPT and USCIS Changes
Post-completion Optional Practical Training (OPT), which allows students to work after graduation, remains a separate benefit. But Joseph Edlow, the new head of USCIS, intends to limit this programme, causing concern among students.
Effect on Indian Students and NRIs
For Indian students and NRIs, who often use a second master’s or Day-1 CPT as backup plans for H-1B visas, this is a major setback. These loopholes are being closed by the current administration.
The rule is open for public comments but is likely to become official soon. Students should consider alternatives and prepare backup plans as no safety nets remain.
