After the US started revoking F1 visas over past arrests, some even without charges, panic is spreading among H-1B workers too.
One H-1B holder shared how an argument with his wife years ago led to his arrest in a case of domestic violence. While it was dismissed without him being convicted, seeing what’s happening to F1 students, he’s now fearing a similar fate.
Netizens reassured him saying that students are easier targets because their SEVIS status can be canceled instantly. On the other hand, H-1Bs don’t use such a system, so the process needs formal steps through USCIS.
However, it’s never a guarantee as a fellow H-1B also got flagged after similar allegations. No case was ever filed, but USCIS is now demanding police reports he can’t even get.
This led to him getting the dreaded notification that his worker visa had been revoked. No trial, no charges, still a black mark is enough to throw you out of the US.
The F1 crackdown could just be the beginning. H-1Bs fearing similar consequences because of their past should talk to a lawyer before it gets too late.
