F-1 to B-1/B-2: Visa Rejected After 6 Years in US

A former F-1 student from India recently faced a B-1/B-2 visa denial. The applicant had spent six years in the United States, completing B.Sc, OPT and STEM OPT. After returning to India in September 2025, they began managing their family’s manufacturing business.

Despite a lawful stay in the US and active involvement in business operations, the tourist visa application was refused. The decision came as a surprise to the applicant. It has since sparked discussion among visa experts.

The consular officer cited Section 214(b) as the reason for the denial. This section relates to suspected immigrant intent. In such cases, officers believe the applicant may not return after visiting the US.

Experts note that applicants who recently completed long term stays are often viewed as high risk. Former students are sometimes suspected of planning to re enter and adjust their status. This perception can affect B-1/B-2 approvals.

Officials may also question applicants running family businesses. Without strong documentation, such roles may not be considered stable employment. Clear financial records and proof of ownership become crucial in these situations.

However, experts point out that visa outcomes can vary widely. In similar circumstances, another applicant reportedly received approval without difficulty. Much depends on how convincingly the case is presented during the interview.

The former student has been advised to strengthen their business profile before reapplying. Building detailed financial records and operational history could help. Waiting at least six months before submitting a new application is also recommended.
