H-1B Stamped, Can You Enter US on F-1 Visa?

A student on STEM OPT is now stuck in yet another immigration grey zone. They are in a dilemma— if they get their H-1B visa stamped in August, can they still enter the US on a valid F-1 visa before October 1?

This person took to social media to explain their situation. Their F-1 STEM OPT is valid until July 2026, and they’re planning international travel from July 14 to August 14, 2025. But their H-1B will get stamped on August 3, which begs the question of whether they can still re-enter on their student visa.

This confusion is caused because the H-1B status doesn’t become valid until October 1. Until then, technically, they are still on F-1 status, but it gets more complicated.

Once you get the work visa stamped, CBP (Customs and Border Protection) officers at the airport may treat you as switching to H-1B status, even if it starts later. Some may even deny entry on F-1, saying your “intent” to enter the country has changed.

Many advisors suggest avoiding travel during this transition period. Because if you leave with an F-1 visa and get your H-1B stamp while you are overseas, you can only safely enter the US on October 1st, or ideally, 10 days before on September 20th.

Always double-check with your DSO (Designated School Officer) and an immigration lawyer before making such decisions in the current political climate.
