The “specialty occupation” rule has been modified to prohibit general degrees like MBA, which are not “directly related” to the position they might be applying for. This will restrict workers of varied backgrounds and can affect their flexibility in other careers.
Some relief for students will be that their F-1 visas will get extended during the “cap-gap” period. Once they land their jobs, they can safely transition to their H-1B visas without fear of removal from the country once they graduate.
The US Citizenship and Immigration Services (USCIS) promises faster processing by deferring to prior approvals unless a major issue arises. This is a positive move forward, but it doesn’t address long delays in new applications.
Another issue that has gone unnoticed is the visa cap of 65,000, which fails to meet the increasing demand of aspiring Indian workers. It is an outdated limit and keeps the talent in doubt for years at a stretch.
In conclusion, these changes seem rather disappointing and ignore the bigger picture of the booming H-1B visa demands in India. By clinging to such outdated policies and half-measures, America might risk losing global talent moving forward.
