H-1B Approved, Deadline Arrives, Still No Proof

October 1 is a key date for international workers in the United States. It marks the start of the new financial year and the day approved H-1B visas officially take effect for many applicants.

Approval without physical notice

One former F-1 student remains uncertain despite an online approval in July. While USCIS tools show the petition as approved, the employer has received no official notice. The missing I-797 document leaves the worker unsure of their legal status.

Change of status confusion

If the petition was approved as a change of status, the transition to H-1B should begin automatically on October 1. However, without the physical I-797, travel outside the U.S. could cause major issues, including the need for a visa stamp.

Scrutiny adds pressure

With H-1B visas under heavy scrutiny, even small delays feel like major risks. Workers fear for their jobs and long-term career plans, especially when USCIS communication is slow and approvals don’t translate into immediate security.

Employer’s urgent response

The employer is now filing non-delivery e-requests with USCIS in an attempt to track the missing notice. For the applicant, this situation shows how fragile the system is, where even timely approvals don’t guarantee a smooth transition.
