H1B Panic: Arrests, Random RFEs Causing Trouble?

H-1B visa holders are in real panic. The latest immigration crackdown in the US is putting their status at risk over even the smallest issues.

An H-1B worker, nervous about his arrest a few months ago, shared his issue on social media. After being held for 12 hours, he was released with a judge-signed order stating “no charges filed.”

However, the courts have no additional records, and even his attorney couldn’t find any further details. Now he fears Customs and Border Protection (CBP) could question him about the arrest and they have no documentation to clear their name.

On top of that, this person is also transferring their H-1B. They submitted their I-129 for premium processing, but instead of a smooth process, they received a strange Request for Evidence (RFE) asking for biometric information.

This request could lead to major delays. Some applicants have waited over 40 days for a response, and if the case is handed to the FBI, it could drag on even longer.

Many worry that this could cause their job offer to be rescinded. The company might back out before the transfer is even approved.

Earlier a case like this wouldn’t have been a concern for immigrants. However, now one past arrest or unexpected RFE could jeopardize your future in the US.
