H1B Denied in UK—Lawful But Risky Move

An Indian professional on an H1B visa recently faced an unexpected setback when his U.S. visa was denied in London under section 214(b). This has sparked concerns among other visa holders about the potential risks of getting their visas stamped outside their home country.

The individual, who has an Indian passport and an approved I-140, went for a visa interview in May for his third H1B extension. During the interview, the consular officer asked why he wasn’t getting the stamping done in India. Even after explaining that he was in the UK to visit family and friends, his visa was denied based on 214(b).

This section is usually linked to tourist or student visa denials, not H1B cases. It suggests that the applicant didn’t demonstrate strong enough ties to a country outside the U.S.—which is quite unusual for someone with a solid immigration history.

The applicant hasn’t been back to India in almost five years, which might have influenced the officer’s decision. Although third-country stamping is legally permitted, consular officers have a lot of discretion and might see such choices as a sign of avoiding their home country or lacking ties.

Immigration attorneys point out that 214(b) denials in H1B cases are rare but not unheard of, especially when interviews happen outside the applicant’s home country or nationality. Without a formal appeal process, most people in this situation have to reapply—usually in their home country—with more comprehensive documentation.

This case underscores the increasing uncertainty for Indian H1B holders trying to navigate the complexities of stamping outside India. While third-country processing can offer some flexibility, it also carries hidden risks that aren’t always apparent on paper.
