H-1B Scam: Desi Firm Offers Lottery Pick With No Job

Fraudulent desi consultancies are reportedly adapting to changes in the H-1B visa system. Despite the introduction of a weighted lottery, new methods are emerging that raise concerns about misuse. These practices are affecting genuine applicants seeking fair opportunities.

A Reddit post has triggered fresh debate among H-1B aspirants. A user claimed knowledge of a desi consultancy that keeps candidates employed on paper even when they do not have an active job. This allegation has sparked widespread discussion online.

According to the post, the candidate was on an F-1 visa and had lost their contract job. Instead of being removed from payroll, they were allegedly retained with reduced pay. They received wages for only 20 hours despite earlier full-time work.

This arrangement helped extend their employment record on paper. It also allowed the consultancy to file their H-1B registration at a specific wage level. This detail is important due to the recent shift to a wage-linked selection system.

Under the new system, higher wage levels have better chances in the lottery. The post suggests some consultancies may be adjusting wage records to improve selection chances. This could allow candidates without active roles to secure H-1B picks.

Such practices may reduce opportunities for genuine applicants. The issue highlights concerns about fairness in the system. It also raises questions about how effectively current rules prevent misuse and manipulation.

US authorities have already increased scrutiny around H-1B misuse. Recent crackdowns indicate awareness of these loopholes. However, there is a growing demand for stricter action against firms involved in such fraudulent practices.

Experts suggest a targeted crackdown on such consultancies. A focused approach could protect genuine applicants without affecting legitimate visa holders. This may strengthen trust in the H-1B system over time.
