H4 EAD Hack: 540-Day Extension from Traveling?

Many H-4 visa holders in the US risk losing their jobs because their work permit (EAD) expires before the USCIS approves the renewal. Even if they applied on time, they can only keep working if their I-94 is still valid.

If the I-94 has expired, the automatic 540-day work extension doesn’t apply. However, the immigration lawyers suggest a workaround that can help you with the extension. Just a short trip to Canada or Mexico can help them get a new I-94, which then lets them keep working legally.

This only works if the person leaves the US before their current I-94 expires. After coming back, US border officers may give them a new I-94 linked to their spouse’s latest H-1B approval.

Even if their visa stamp is expired, they can re-enter under automatic visa revalidation (AVR), as long as they don’t stay more than 30 days and don’t apply for a new visa while abroad. Flying is better than driving, and it’s safer to travel with the H-1B spouse.

To increase the chance of success, immigration lawyers advise they should carry all approval notices, passports, job letters, and marriage certificates. Right after coming back, they must check the CBP website to download the new I-94.

This travel trick is not foolproof, so it’s best to speak with your personal lawyers first before ending up with some complications for your unique case.
