
The Madras High Court has recently denied custody to an American-Indian father residing in the US, who was seeking interim custody of his two children living with their mother in India. These children hold American citizenship.
Following a marital dispute, the children’s mother returned to India and settled in Chennai. Nevertheless, the court, led by Justice RN Manjula, rejected the plea, emphasizing the importance of the children’s welfare and continuity in India. The judge explained that abruptly changing the children’s custody would disrupt their lives.
The petitioner can still meet his children in India, and there is no evidence of parental alienation. Consequently, the petition was ultimately dismissed.
However, this case is quite different as it involves parental disputes, which is already a very complex issue. Let’s hope for the best for this family.
