Indian Lawyer Crushes Trump Tariffs: India Now Paying 10%

In a landmark judgement, the US Supreme Court has ruled against the “emergency” reciprocal tariffs imposed by Donald Trump. The case was led by an Indian-American attorney, delivering a major setback to the US President.

The court ruled 6–3 that Trump exceeded his authority by using the International Emergency Economic Powers Act to impose sweeping tariffs. These tariffs affected multiple countries, including India.

Indian-origin lawyer Neal Katyal argued the case pro bono on behalf of American small businesses. He described the verdict as extraordinary while speaking to US media.

Katyal said he stood in court as the son of immigrants to challenge unconstitutional action. He praised America’s self-correcting system, stating that even the most powerful leader cannot override the Constitution.

The case focused on Trump’s decision to impose 25% tariffs on Canada and Mexico, 18% on India, and at least 10% on other countries. These were justified by declaring national emergencies linked to trade losses.

However, the US Chief Justice noted that the law does not grant presidents unlimited powers to impose tariffs. This observation formed the basis of the ruling.

The verdict has drawn widespread praise in India. Many Indians hailed the Indian-American lawyer for standing up for small businesses and challenging tariffs imposed on India.

Some see the ruling as symbolic at a time when anti-India sentiment is perceived to be rising in parts of the US. Online discussions have linked the verdict to ongoing concerns about trolling and hate speech.

Following the judgement, the Trump administration appeared unsettled. Trump called the ruling a disgrace and criticised judges, including those he had appointed.

Within hours of the verdict, Trump signed a fresh executive order imposing new 10% tariffs on Indian goods. He also stated that the US-India Trade deal would remain unchanged.

Later, the White House clarified that the earlier 18% tariff would be reduced to 10% starting February 24. The situation remains fluid, with mixed signals from the administration.

While Katyal’s legal victory has provided relief to Indian exporters, Trump is reportedly still pushing to restore the 18% tariff rate agreed earlier under the trade deal with India.
