No H-1B Renewal Slot, $100K Fear Threatens US Career

An H-1B worker is currently stranded in India as their I-797 approval remains valid only until May. Their physical visa stamp expired in October 2025, and they have been unable to secure an interview slot.

The absence of available appointments has blocked their return to the United States. Without a fresh visa stamp, re entry is not possible.

The worker’s company lawyers are reportedly unwilling to file for an H-1B extension. They fear triggering a $100,000 fee that may apply when filing for applicants located outside the US.

This fee is generally imposed under specific conditions when an H-1B petition is filed for someone abroad. In certain cases, extensions submitted while the employee is outside the US could attract this cost.

If the worker fails to re enter before May, their US employment could be at serious risk. Missing the deadline may effectively end their long standing career.

Some Reddit users have suggested travelling to Dubai for stamping. Dubai is known for faster visa appointment availability in certain categories.

The UAE also offers remote work visas, which may allow individuals to continue working while waiting for interview dates. However, travelling to a third country for stamping carries significant risk.

US regulations restrict certain third country national visa appointments. Violating these rules could lead to further complications.

For now, the worker’s safest option is to closely monitor the visa scheduling portal. They must hope an interview slot opens before their I-797 expires.
