OPT Turmoil: Working Before EAD Delivery Illegal?

A small mistake can quickly turn into a major immigration issue in the complex and unforgiving U.S. system.

Recently, an F-1 visa student approved for OPT (Optional Practical Training) work authorisation thought they may have acted too soon by starting work before their physical EAD card arrived.

OPT Approval Came Before EAD Card

The student shared that their OPT was approved on 8 July through premium processing. However, the employer requested a start date of 9 July.

Trusting the approval notice, the student updated the SEVP portal with this date, even though the physical EAD card only arrived by post on 17 July.

Legal Concerns Over Start Date

Now, after reading online cases, the student is worried. Some sources say starting work before receiving the actual EAD card, even if approved, could violate immigration rules.

While the work period fell within the printed start and end dates on the final EAD, questions remain about whether holding the card physically is mandatory before starting employment.

Some believe that if the printed EAD start date aligns with the work done, the student is legally covered. Others caution that beginning work without the card in hand even with approval can be risky.

In this case, since the printed EAD reflects the same 9 July start date, the student may not face consequences.

With rising OPT and F-1 visa enforcement actions, many students are getting caught in grey areas. A single mistake, even unintentional, can have serious immigration consequences.
