Trump’s Gold Card visa programme is already facing skepticism from immigration attorneys and applicants who refrain from applying for the “shortcut” despite the hype.
According to reports, the concern for many attorneys is that applicants may lose a non-refundable $15,000 fee if courts eventually strike the programme down. That is why they advise their wealthy clients against opting for the Gold Card amid the ongoing lawsuits against Trump’s policies.
The Gold Card, announced in September, promises a fast-track path to US permanent residency for foreigners willing to make huge financial contributions. Individuals must pay $1 million, while companies are expected to contribute $2 million.
Houston-based immigration attorney Steven Brown publicly stated that any lawyer “worth their salt” would advise clients against the Gold Card. He argued that the existing EB-5 investor visa is far safer because it already has congressional approval.
The Trump programme is already facing multiple lawsuits. Critics claim the administration allegedly created a new visa route without the proper legal route.
Even the response has been weaker than the administration claimed. According to DHS court filings, only around 165 applicants paid the $15,000 fee so far, and only 1 card was sold in 6 months.
The Trump Gold Card may be flashy, but it is far from legally secure under the current climate. It is best to seek immigration legal experts to get advice on individual cases.
