US midterms raise H-1B visa slot concerns
The Democratic party of the US has gained a majority in both the House and the Senate of the Congress in the midterms. As a result, many Indians online have been speculating on the changes immigration may get.
The biggest question is whether Democrat control of Congress will help the lack of H-1B slots in India. Since October 2025, changes to H-1B adjudication have left next to no interview slots.
Speculation has remained reserved, as immigration remains under control of Trump. However, with Democrat control, immigration lawyers expect much more checks and controls of anti-immigration bills.
People are also not hopeful about any concessions to F-1 students, and relaxation of OPT and CPT rules. The instability faced by foreign students and workers in the US comes from deeper racial hatred and policies.
As a result, the H-1B visa will likely remain controversial. Speculation says that even pro-immigration politicians might not try to fix it, at least not immediately.
Lawyers state that the Democratic party cannot immediately reverse the $100,000 H-1B fee. They will also find it difficult to counter the proposed $70,000 OPT fee.
However, it is likely that the Democrats can and will add oversight to Congress. New restrictive laws can be blocked when introduced.
