No Update on New $250 Integrity Fee: H1B, F1 Panic

Starting October 1, 2025, a $250 “visa integrity fee” will apply to almost all nonimmigrant visas, including tourists, students, and H-1B workers. Despite the announcement in July as part of the One Big Beautiful Bill, applicants remain anxious due to the lack of clarity on payment and refunds.

Unclear Payment and Refund Rules

The fee aims to discourage visa overstays and is refundable if rules are followed. Yet, neither the Department of Homeland Security nor the Department of State has explained how to pay it or claim a refund, leaving applicants unsure and worried.

Difference From H-1B $100,000 Payment

This integrity fee differs from the $100,000 H-1B payment required for entry of new H-1B holders. The integrity fee applies to all non-immigrant visas, while the $100,000 fee is specific to H-1B visa issuance and does not affect approvals or stamping.

Legal Standing and Permanence

Unlike the H-1B fee, the $250 integrity fee is part of a Bill passed by Congress. While the White House may face court challenges, the Bill has no legal hurdles so far, making the fee more permanent and harder to reverse.
