H-1B Withdrawal Mess: F-1 Status Lost Over Delay

An international student has been trapped in a U.S. immigration nightmare after USCIS failed to update their H-1B status on time. The delay has left them out of legal status despite following every rule and timeline correctly.

From OPT to H-1B Transition

After completing their degree, the F-1 visa holder was working under Optional Practical Training (OPT) and awaiting their STEM extension. During this period, their employer filed an H-1B petition, which was approved with an official start date of October 1.

Job Lost, H-1B Withdrawn

Just before the new visa could take effect, the student lost their job. The employer immediately withdrew the H-1B petition. But USCIS failed to process or confirm that withdrawal, leaving the student in legal limbo even weeks after the request.

Bureaucratic Delay Triggers SEVIS Termination

Because of this delay, the student’s F-1 visa record in SEVIS (Student and Exchange Visitor Information System) automatically terminated on October 1, assuming their H-1B had taken effect. This system error wasn’t their fault, but it erased their student status overnight.

DSO Helpless Until USCIS Responds

Their Designated School Official (DSO) has stated they can’t restore the terminated SEVIS record until USCIS formally confirms the H-1B withdrawal. Until that happens, the student remains “out of status” on paper, even though they did nothing wrong.

Fear and Uncertainty for Students

In the current U.S. immigration climate, even one day of unlawful stay can trigger severe consequences, including detention or visa bans. For this student, the loss of F-1 status due to government delay has turned into a terrifying legal and emotional ordeal.

No Accountability for the Error

No agency has accepted responsibility for this mistake. What’s being dismissed as a small technical delay may now endanger the student’s future in America—a stark reminder of how fragile the immigration system can be for law-abiding international students.
