Only Online Visa Filings? New USCIS Rule Sparks Fear

The US immigration system may soon move towards fully digital visa processing, raising fresh concerns among applicants. Many fear that the current infrastructure may not handle heavy traffic and long pending backlogs efficiently if online filing becomes mandatory.

Immigration expert Aaron Reichlin-Melnick stated that the change is being introduced through an interim final rule. This allows USCIS to implement it faster than standard regulations. The move could impact H-1B workers, F-1 students, green card applicants, and family-based petitions.

Indian applicants form a major share of employment-based US immigration categories such as H-1B, F-1, L-1, EB-2, and EB-3. Many already face long waiting periods due to country caps. A complete shift to digital filing may add another layer of uncertainty.

USCIS has gradually introduced online filing for several forms over the years. Supporters believe this transition can improve efficiency, reduce paperwork delays, and offer better tracking of applications through digital systems.

However, critics highlight ongoing technical issues within the system. Applicants have reported frequent glitches, document upload failures, and login problems. These challenges raise doubts about the readiness of a fully digital immigration process.

For Indian applicants working with US-based lawyers across time zones, the change may create additional pressure. As of now, USCIS has not confirmed which forms will become mandatory first, and further clarity is still awaited.
