
After hearing the arguments of both the sides, the High Court canceled the Pre-Closure Notification and also asked the Government not to go about the Re-tenders of the Project. It has to be seen if the Government will continue Navayuga in the Project or approach the Supreme Court in the issue.
In the court, Navayuga argued that the Project site is not yet totally handed over to it and there should be no question of penalizing it. Further, Navayuga told the High Court that APGENCO canceled the tenders on the insistence of the State Government.
But then, the State Government is just a third party in the agreement and can not force Political Decisions on APGENCO. TDP has welcomed the court decision and stated that this judgment is a clean chit for the Polavaram Project and the TDP Government’s rule.
