H1B Lottery Fraud: Who’s Safe? Who Is Not?

Recently, the USCIS released a statement that some small companies were indulging in fraud by meddling with the actual process by putting in as many as 10 applications for each person.

They have colluded to ensure that their prospective employees will win the coveted H1-B visa given to skilled foreign workers in this year’s lottery. The Biden government intends to find fraudsters on such activities, and this has the immigrant community quite concerned about what might affect whom.

According to a renowned US Law firm, the employees can choose any employer they wish to work with, and there will be no restrictions. It is best to seek a job and request for H1-B visa instead of seeking multiple job offers and submitting multiple registrations.

Employers cannot collide with other employers and submit multiple registrations on behalf of their employers or prospective employers to misuse the system. If a person hasn’t approached other employers for a job, then the company can go ahead with the processing of an H1-B visa in such a case.

Another important point is if the employee or prospective employee submits multiple registrations, this will not affect the employer’s business. The Law Firm has asked people to understand the difference between the two and has asked people to spread the message to avoid panic.
