Kavitha’s New Strategy for Getting Bail

BRS MLC Kavitha is facing ongoing trouble in the Delhi liquor scam case. Kavitha has not been granted bail in this case even after four months of arrest. MLC Kavitha, who is making various efforts to secure bail, has now filed a petition for default bail.

The court has extended Kavitha’s judicial custody in the Delhi liquor scam case while repeatedly rejecting her bail petitions. Efforts by Kavitha’s lawyers for interim bail have been unsuccessful. Recently, Kavitha approached the court for default bail.

As the CBI could not complete the investigation within the stipulated period, Kavitha’s lawyers petitioned the court to grant bail to their client. They requested the court to grant default bail immediately. According to CrPC 167(2), in relation to any case, the investigating agencies must complete the investigation within a specified period and file the charge sheet in the court.

If the police do not file the charge sheet on time, they must seek permission from the court. Failing to do so, the accused have the option of obtaining bail, known as default bail. As the deadline for Kavitha’s case expired, her lawyers filed a default bail petition on her behalf. We have to wait and see what decision Rouse Avenue Court will take on this bail petition.
