High Court Defines Boundaries of Penetrative Assault

The Kerala High Court has delivered an important ruling on the interpretation of penetrative sexual assault under the Protection of Children from Sexual Offences (POCSO) Act.

In the judgment, the court held that certain forms of contact involving a victim’s private parts can amount to penetrative sexual assault and rape, even in the absence of traditional forms of penetration. The decision underscores the wide protective ambit of the POCSO Act, which is designed to safeguard children from various forms of sexual abuse.
