
The Supreme Court of India passed a verdict in a petition regarding the creation of a policy for mandating menstrual leaves for women employees across the nation.
The court asked the union government to create a model policy. The petition was filed saying that two states in the country are giving leaves during menstrual periods and requested the court to implement the rule across the country.
Chief Justice of India DY Chandrachud and Justices JB Pardiwala and Manoj Misra, said this is a policy issue and not something courts should decide. The judges also mentioned that giving menstrual leave might backfire and harm women by making companies less likely to hire them.
“How will this leave help more women join the workforce?” the court questioned.
The judges asked the secretary of the Ministry of Women and Child Development to look into the matter and come up with a decision after talking to different stakeholders to see if a model policy could be created.
The court also clarified that states can take their own steps on this issue and won’t be affected by the Centre’s decision-making process.
Earlier in February, the Supreme Court rejected a Public Interest Litigation that aimed to make menstrual leaves mandatory for female students and working women in all states.
