
The Supreme Court of India has made it clear that there is no legal vacuum when it comes to hate speech, stating that existing criminal laws are already sufficient to deal with such offences.
A bench of Justice Vikram Nath and Justice Sandeep Mehta made this observation while hearing a batch of petitions seeking stricter action and fresh guidelines on hate speech.
The court rejected the argument that current laws are inadequate. It pointed out that provisions under criminal law already address acts that promote enmity, religious insult and public disorder. According to the bench, the real issue lies not in the absence of law, but in its implementation.
The judges underlined an important constitutional principle, stating that creating criminal offences is the exclusive domain of the legislature. Courts, they said, cannot introduce new offences or expand criminal liability through judicial directions. At most, the judiciary can highlight concerns or suggest reforms to the government.
While acknowledging the concerns raised by petitioners, the court observed that adequate legal remedies are already available. Police authorities have the power to register FIRs in such cases, and citizens can approach magistrates if there is inaction.
The bench also left room for future changes, noting that both the Centre and state governments can consider new laws if required, based on evolving situations. Reference was also made to recommendations by the Law Commission in this regard.
The petitions were linked to various controversial incidents over the years, including allegations related to social media campaigns, television content and public speeches. Earlier, in 2023, the Supreme Court had already directed states to act on hate speech cases even without formal complaints.
The ruling sends a clear message that the focus should now be on effective enforcement rather than expecting new laws to address the issue.
In matters like hate speech, the challenge is not defining the offence, but ensuring the law is applied consistently and without delay.
