POCSO Case Quashed by Bombay HC

Courts are often required to balance strict enforcement of criminal law with the need to assess whether continuing a prosecution serves any meaningful purpose. This balance becomes especially sensitive in cases involving children and close family relationships.

Such matters often involve emotions, misunderstandings, and long-term consequences. Judicial intervention in these cases requires careful consideration of both legal principles and human realities.

In a recent order, the Bombay High Court quashed a POCSO case against a 52-year-old maternal uncle. The decision came after the minor girl and her parents filed a no-objection to the plea.

An FIR had earlier been registered under Sections 8 and 12 of the POCSO Act and Sections 74, 75 and 78 of the BNS. A chargesheet had also been filed in the matter.

However, the girl’s statement before the Judicial Magistrate under Section 183 BNSS clearly stated that she had no complaint against her uncle. She later filed an affidavit before the High Court confirming that her consent was voluntary and without any coercion.

The Court observed that the dispute had arisen due to a misunderstanding within the family. It relied on precedents laid down by the Supreme Court to conclude that there was no legal bar to quashing the proceedings.

The petition was allowed subject to the accused depositing ₹1.5 lakh. The amount is to be used for purchasing a laptop for the girl’s education, with any remaining sum directed to the High Court Employees Medical Welfare Fund.

The order has sparked wider debate. POCSO offences are considered crimes against society, raising questions about how the legal system should respond when allegations are later withdrawn.

While the decision reflects judicial pragmatism, it also reopens discussions on accountability, misuse of law, and the broader social message such outcomes may convey.
