A passenger has raised new concerns against Etihad Airways.
Refund Issue Over Travel Ban
The passenger said the airline refused to issue a full refund after being unable to travel due to a U.S. presidential proclamation restricting certain visa holders. Based in Georgia, the person had booked an Etihad flight but was advised not to board by company immigration lawyers.
Visa Restrictions Explained
The proclamation barred H-1B visa holders and others from entering the United States. Reports say several passengers were offloaded from the same flight for this reason, while the flight continued with those unaffected.
Etihad’s Response
Etihad acknowledged the situation but pointed to its Conditions of Carriage. Under Article 13, passengers must ensure they meet entry requirements. The airline also said refunds would only apply under the original fare rules.
Complaint with U.S. DOT
The passenger has now filed a complaint with the U.S. Department of Transportation. The April 2024 DOT Final Rule requires refunds in cases of government-imposed restrictions. This rule builds on earlier actions against airlines such as Lufthansa and KLM.
Conflict Between Policies and Law
The case highlights the clash between airline refund policies and consumer protection laws. U.S. regulations generally support passengers, which may put pressure on Etihad to provide a full refund.
