Consultancy Silence Threatens H1B Legal Status

When an H1B visa holder finds themselves out of a job, the pressure really ramps up. They have just a 60-day grace period to secure new sponsorship or risk losing their legal status. In this case, the deadline is July 17, 2025, but the confusion around paperwork is adding to the stress.

Company A, a consultancy, submitted the transfer request under regular processing, even though they had asked for premium processing. They’re worried that a Request for Evidence (RFE) could slow things down, and regular processing means a longer wait—definitely a gamble with the clock ticking.

A tempting full-time offer from Company B has come in, but their team is saying that filing a transfer within a week is going to be a challenge. This puts the worker in a tough spot, caught between two employers and that looming deadline.

Interestingly, Company B can actually file using Company A’s receipt number even before the worker officially starts there. This “bridge filing” does come with its own risks, especially if Company A’s petition gets denied or withdrawn.

Getting that receipt number from Company A is essential, but it can often be delayed or kept under wraps, particularly with consultancies. Employers are supposed to provide it, but many don’t.

After filing, they can request premium processing to speed things up. This might be the only shot at meeting the deadline and maintaining legal status.

Once the grace period runs out without a valid petition either pending or approved, legal status is lost right away. Leaving the country isn’t an option, so timing and decisive action are absolutely critical.

This whole situation really highlights just how delicate and complicated H1B transfers can be. The lack of transparency and tight timelines create a high-stakes race for survival.
