EB-1B Mess: 10-Year Green Card Reduced to 2 Years

An EB-1B green card applicant has run into a serious administrative mistake. They were wrongly issued a two year conditional green card. If this happens to you, it can feel alarming because this status does not match your employment based application.

The confusion deepened when the applicant’s spouse received a correct ten year green card. Conditional green cards apply only to marriage based LPR cases. They do not apply to EB-1B employment based approvals.

You should include a copy of the incorrect notice and your original EB-1B approval. Clearly explain the error in writing. If you already received the conditional card, you must return it with the I-90 application.
