H-1B Wage Lottery Confusion: Level 4 Pay, Level 3 Odds?

The new wage based system for the H-1B lottery has created confusion among many applicants. While the concept appears simple, differences in legal interpretation and employer decisions can create uncertainty. Several workers are now trying to understand how prevailing wage levels are actually determined.

One applicant recently shared concerns about their H-1B wage classification. According to publicly available data from the Foreign Labor Certification Data Center, the applicant’s salary falls within the Level 4 wage range for their occupation.

However, the company’s immigration consultant explained that salary alone does not determine the official wage level. Other factors such as education requirements, years of experience, and job responsibilities are also considered when assigning the final classification.

Despite earning a salary that matches the Level 4 range, the consultant reportedly said the employee could only be placed under Level 3. The reason was that the role itself was evaluated as a Level 3 position based on its requirements.

The consultant also mentioned that employees with more than 12 years of experience are usually considered for Level 4 roles. In addition, the company reportedly follows an internal guideline where only a limited percentage of employees are placed in the highest wage category.

An immigration attorney clarified that wage levels are determined primarily by the nature of the job. Employers first evaluate how complex the role is and how much experience the position requires before deciding the wage level.

Once the job level is determined, the employer must simply ensure that the salary meets or exceeds the minimum wage required for that specific level. Because of this system, salary and wage level do not always match perfectly.

This means an employee may earn a salary within the Level 4 range but still be classified under Level 3 if the job itself is considered a Level 3 position. The wage level used during H-1B registration may also differ from the level used during the final petition filing.

As the wage based H-1B system evolves, many workers are finding the process difficult to understand. Public wage data alone often does not explain how companies and legal teams determine the final wage level.
