ICE Targets OPT Fraud: What Should Indian F-1 Students Do?

ICE’s latest crackdown on alleged OPT fraud is reportedly creating anxiety among Indian students in the United States, particularly F-1 visa holders relying on STEM OPT pathways while pursuing long-term H-1B opportunities.

Immigration attorneys from Reddy Neumann Brown PC recently discussed concerns surrounding reports that US Immigration and Customs Enforcement had flagged more than 10,000 foreign students linked to what officials described as “highly suspect employers.”

According to the attorneys, ICE suspects that some students may have received OPT authorisation without actively working in legitimate employment roles. Reports also suggest that certain firms allegedly outsourced supervision responsibilities, including to India-based entities.

Legal experts noted that such arrangements could potentially violate STEM OPT regulations, which require proper US-based supervision and monitoring. However, attorneys also pointed out that the flagged cases reportedly account for less than one percent of the overall F-1 student population.

Despite that, immigration experts warn that even genuine students could now face stricter scrutiny from authorities. Increased documentation checks, surprise site visits and additional compliance requirements are expected to become more common in the coming months.

While many support action against fraudulent practices, some experts believe the wider student community may now experience growing fear and uncertainty because of a relatively small number of alleged violations.

Observers also noted that comments made during a recent press conference by ICE Acting Director Todd Lyons are being viewed in the context of broader immigration policy discussions related to future F-1 visa regulations.

Attorneys further warned that upcoming immigration policies under the Trump administration could potentially make visa extensions, transfers and OPT approvals more difficult for international students in the future.

Because of this, lawyers are advising students to maintain complete records related to employment and OPT compliance. Students have been urged to keep salary slips, Form I-983 documents, supervisor information and proof of actual work readily available at all times.

Legal experts are also warning students to stay away from suspicious “pay-to-stay” arrangements that allegedly promise visa status without genuine employment opportunities. They caution that involvement in such setups could create serious immigration complications later.

The latest developments have once again highlighted the growing concerns surrounding international student visa policies in the United States, especially for Indian students navigating the increasingly competitive immigration system.
