When H-1B Expires Before DMV Cooperates

An illinois Indian professional just reported being stuck between renewing their driver’s liense and getting an H1B extension. Their prior I-797 approval had already lapsed, and now they find themselves within the 240-day grace period only with a receipt notice.

This is the experience of many H1B holders. USCIS permits extended work for 240 days, but state DMVs do not always accept the I-797C receipt to renew a license.

In Illinois and elsewhere, policies differ by region. Some DMVs will take the receipt along with additional documents such as proof of employment, while others will not accept it.

Without a proper license, everyday life is more difficult. Driving to work, doing errands, or picking up children feels impossible–partiicularly in neigghborhoods with poor public transportation.

The root of the problem is the disconnect between immigration and DMV policies. Employees are legal on paper but trapped in practice–waiting for approvals with no clear way to continue driving.
