The Delhi High Court has allowed IRS officer Sameer Wankhede to continue his defamation case in Mumbai. The case relates to the Netflix series The Ba**ds of Bollywood.
Wankhede has alleged that the series makes indirect references to the Aryan Khan case. He claims this has harmed his reputation due to similarities shown in the narrative.
The court ruled that it did not have territorial jurisdiction over the matter. As both Wankhede and the production house are based in Mumbai, the case must be heard there.
Justice Vikas Mahajan passed the order. He permitted Wankhede to file his plaint before the appropriate court in Mumbai.
Both parties have been directed to appear before the City Civil Court Mumbai on February 12. Wankhede is expected to formally initiate proceedings on that date.
The decision followed an application under Order VII Rule 10A of the Civil Procedure Code. An earlier ruling had returned the plaint for being filed in the wrong forum.
Earlier, Wankhede approached the Delhi High Court claiming that a character in Episode 1 was a defamatory portrayal of him. He said the character’s appearance and conduct closely mirrored his own.
According to Wankhede, the portrayal was widely identified as him in media reports and caused reputational damage. He argued that the depiction went beyond creative liberty.
The producers denied the allegations. They stated the series is fictional and satirical and does not depict the Cordelia cruise raid.
The matter will now be closely watched in Mumbai. The outcome between Sameer Wankhede and Red Chillies Entertainment remains uncertain.
