There are approximately 3.81 lakh prisoners languishing in various jails across the country and about 2.54 lakh are undertrials. Only one-third, or 1.27 lakh, of those in jails are convicted and are serving the sentence. There are cases when prisoners die in jails as under trials before the case coming to hearing or getting a judgement.

Many of these undertrials have spent more time in jail than the sentence they would have got had they been convicted for the crime they were arrested for. In fact the judiciary of our country grew inactive only after the independence. In British India, the ratio of undertrials to convicts was just the reverse where two-thirds of the prison population was those convicted.
