India had issued first ever passport to a surrogate baby. Hyderabad Passport office had issued the passport to the surrogate baby is of an Non Resident Indian (NRI) couple. There is no guidelines for surrogate babies in Indian passports. The biological declaration of the father along with the DNA report of the baby from the Centre for Cellular and Molecular Biology (CCMB) were submitted for the issue of the passport.
There are still issues in passports for surrogate babies especially regarding the name to be mentioned on the surrogate baby’s passport. Should it be the biological mother’s name, or should surrogacy be mentioned? The External Affairs Ministry is yet to issue guidelines regarding this. There are instances where foreign couple opts for Indian mother to carry their surrogate baby due to the simple laws in the country. There are also issues regarding the passports of those babies.
