High Court: Refusing S*x Is Mental Cruelty

The Delhi High Court recently upheld a divorce granted to a couple whose marriage barely lasted 35 days due to their failure to engage in sexual relations.

The court ruled that the intentional denial of a sexual relationship by a spouse constitutes cruelty, emphasizing the significant role of physical intimacy in marriage.

The judge emphasized that nothing is more detrimental to a marriage than disappointment in the bedroom. The court dismissed the wife’s dowry harassment claims due to a lack of evidence and deemed such allegations acts of cruelty.

Referencing a prior Supreme Court case, the Delhi High Court asserted that refusing intercourse without a valid reason could constitute mental cruelty.

The court’s decision suggests that, in the eyes of the law, a healthy sex life is the cornerstone of a successful marriage.
