UK Court: AI Not Recognized Inventor

AI can serve various roles, from a study guide to a personal secretary, but a recent UK court verdict draws a line. The court states that, in a unanimous decision, no AI will be considered an investor.

In 2019, a dispute emerged between Dr. Stephen Thaler and the Intellectual Property Office (IPO) concerning his AI, DABUS, which supposedly independently invented a food container and a light beacon.

Thaler insisted that the AI be acknowledged as the inventor on the patent, claiming ownership rights as the AI’s creator. The recent decision addresses this contentious issue.

The Supreme Court unanimously rejected the claim that an AI, DABUS, could be legally considered an inventor. Lord Kitchin affirmed the IPO’s decision, stating that DABUS lacked personhood and did not devise any inventions.

“It is not a person, let alone a natural person, and it did not devise any relevant invention. Accordingly, it is not and never was an inventor.”

The judges also dismissed the idea that creator Dr. Stephen Thaler could own rights to DABUS’s inventions, deeming it a machine without legal personality.
